Terms & Conditions
 

​1. Application of Terms

​These Terms and Conditions apply to all sales made by Boynesider Office Furniture ("the Company") via its physical showroom, warehouse, or e-commerce website. By placing an order, the Customer ("the Buyer") agrees to be bound by these terms.

​

​2. Product Condition & Disclaimers

​

​2.1 New Goods

​New products are sold with the benefit of the manufacturer’s warranty. The Company’s liability is limited to the terms provided by the manufacturer.

​

​2.2 Second-Hand (Used) Goods

  • ​"Sold as Seen": All second-hand, used, or refurbished items are sold strictly "as seen" and "as inspected." * Mandatory Inspection: The Buyer is required to inspect used goods prior to purchase. By finalizing the purchase, the Buyer acknowledges that the goods are of a quality they find acceptable, taking into account the age, price, and previous use of the item.

  • ​Wear and Tear: Used goods will exhibit signs of previous use, including but not limited to scratches, fading, or minor mechanical wear. These are not considered defects.

​2.3 Ex-Display Products

  • ​Warranty Exclusion: All ex-display products are sold at a reduced rate due to their exposure in a showroom environment. These items are not covered by any manufacturer’s warranty or any warranty provided by the Company.

  • ​Condition: Ex-display items may have minor cosmetic imperfections. It is the Buyer’s responsibility to identify these during inspection.

​3. Online Sales & Right to Cancel (B2C)

​In accordance with Irish Consumer Law, for orders placed strictly online (Distance Selling):

  • ​Cooling-off Period: Consumers (not businesses) have 14 days to cancel the order.

  • ​Condition on Return: Returned goods must be in the exact condition they were delivered. If used/second-hand goods are returned in a state worse than at the time of sale, the Company reserves the right to deduct a diminished value fee (up to 100%).

​

​4. Delivery & Access

  • ​Fit for Purpose: It is the Buyer’s sole responsibility to ensure that the dimensions of the furniture are compatible with the entry points (doors, stairs, lifts) of their premises.

  • ​Aborted Delivery: If a delivery cannot be completed due to restricted access or the Buyer not being present, a re-delivery fee of €[Insert Amount] will apply.

  • ​Damage: Claims for damage during transit must be made in writing within 24 hours of delivery.

​

​5. Retention of Title (B2B Protection)

  • ​Ownership: Notwithstanding delivery, legal and beneficial title to the goods shall remain with the Company and shall not pass to the Buyer until the Company has received payment in full for said goods.

  • ​Right of Recovery: If payment is overdue, the Company or its agents shall be entitled to enter the Buyer’s premises to repossess the goods without prior notice.

​

​6. Payment & Price

  • ​All prices are subject to VAT at the prevailing rate unless otherwise stated.

  • ​For Business-to-Business (B2B) sales, interest on late payments will be charged in accordance with the European Communities (Late Payment in Commercial Transactions) Regulations.

​

​

​7. Limitation of Liability

​The Company’s total liability for any claim shall not exceed the price of the goods supplied. The Company shall not be liable for any indirect or consequential loss, including loss of profit or business interruption.

​

​8. Governing Law

​These terms are governed by the laws of the Republic of Ireland and are subject to the exclusive jurisdiction of the Irish Courts.
